Introduction

These Terms and Conditions ("Terms") govern your use of the MilkMitra mobile application and web platform ("Service") operated by VrikshaNova Private Limited ("Company", "we", "our", or "us"), a company registered under the laws of India, with its registered office at Vrikshanova, Nashik, Maharashtra 422003.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Use of the Service

MilkMitra is a Software-as-a-Service (SaaS) platform designed for dairy farm and milk collection center management. The Service provides tools for milk collection recording, farmer management, payment processing, rate chart management, reporting, and related functionalities.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subscription and Payments

MilkMitra offers both free and premium subscription plans. The premium plan is billed annually at the rate displayed on our pricing page. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes.

Payment for premium subscriptions must be made in advance for the subscription period selected. We accept payments through the methods available on our platform.

Cancellation and Refund Policy

No Cancellation: Once a subscription has been purchased, it cannot be cancelled during the active subscription period. The subscription will remain active until the end of the billing cycle.

No Refunds: All subscription payments are final and non-refundable. Once a subscription is purchased, no refunds will be issued under any circumstances, including but not limited to early termination, dissatisfaction with the Service, or non-usage of the Service.

We recommend that you use the free tier of the Service before upgrading to a paid subscription so that you can verify that the Service meets your requirements.

Shipping and Delivery Policy

MilkMitra is a digital software platform and does not involve the shipping, delivery, or physical transportation of any goods or products. All services are provided electronically through our mobile application and web platform. As such, no shipping or delivery policy applies.

Return Policy

As MilkMitra is a digital SaaS product and not a physical good, there is no return policy applicable. Once a subscription is purchased, it cannot be returned or exchanged. All sales are final. Please refer to our Cancellation and Refund Policy above for more details.

Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is and shall remain the exclusive property of VrikshaNova Private Limited. The Service is protected by copyright, trademark, and other intellectual property laws of India and international conventions.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without prior written consent from us.

User Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.

You retain ownership of the data you input into the Service. We do not sell your personal or business data to third parties.

Limitation of Liability

To the maximum extent permitted by applicable law, VrikshaNova Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

In no event shall our total liability exceed the amount paid by you for the Service during the twelve (12) months preceding the event giving rise to the liability.

Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nashik, Maharashtra, India.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
